apple20logo.jpgBurst.com said Apple agreed to pay a one-time $10 million fee to license its intellectual property and to settle a patent lawsuit filed by Burst.com that has been going on for two years.

According to CNN Money, Burst.com said Apple will make the payment in exchange for a non-exclusive license to Burst's patent portfolio.

Burst agreed not to sue Apple for any future infringement of the patent and any patents that might come from the pending related applications.

Burst retains the right to enforce its patent portfolio against others.

In January 2006, Apple seeks to invalidate Burst's patent and Burst requested in its counterclaims that Apple pay a "reasonable" royalty, and also sought an injunction against further infringement.

In March 2005, Microsoft settled a lawsuit by paying Burst $60 million for a non-exclusive license to Burst's patents.
